必要的沉默

必要的沉默



DSE (Diploma of Secondary Education)公開考試,中文 “寫作能力” 作文題:


今天發生了一件事情,當時我曾經想力陳己見,最後選擇了沉默,我認為沈默是必要的。

以上是文章的開首,試以『必要的沉默』為題,敘寫這篇文章 。。。。。



一出來時很多報章寫稿佬寫稿婆都紛紛以此為題,網誌上也有很多人以此為題寫網誌 。。。。。當時 嗜悲 曾經想力陳己見,最後選擇了沉默。嗜悲 認為沈默是必要的,因為只是一過了不很久(其實很短時間),坊間已經有了新話題,於是就 died down 了。


嗜悲 沉默到到如今才發表己見,各位每次看警匪片犯罪片,不論中外都有聽過,而實際過程 嗜悲 未曾經歷過。但看電影電視劇都曾經聽過:


You may remain silent and anything you say or do may be used against you in a Court of Law!


廣東話譯作:

唔係是必要你講嘅,除非你自己想講,但係你所講嘅嘢,有可能用嚟做呈堂證供。


這就是有著名的:“Miranda Warning”


【維基百科】The Miranda warning, also referred to as Miranda rights, is a warning given by police in the United States to criminal suspects in police custody (or in a custodial interrogation) before they are interrogated to preserve the admissibility of their statements against them in criminal proceedings.

The concept of "Miranda rights" was enshrined in U.S. law following the 1966 Miranda v. Arizona Supreme Court decision, which found that the Fifth and Sixth Amendment rights of Ernesto Arturo Miranda had been violated during his arrest and trial for armed robbery, kidnapping, and rape of a mentally handicapped young woman. (Miranda was subsequently retried and convicted.)

The Supreme Court did not specify the exact wording to use when informing a suspect of his/her rights. However, the Court did create a set of guidelines that must be followed. The ruling states:

The person in custody must, prior to interrogation, be clearly informed that he/she has the right to remain silent, and that anything the person says will be used against that person in court; the person must be clearly informed that he/she has the right to consult with an attorney and to have that attorney present during questioning, and that, if he/she is indigent, an attorney will be provided at no cost to represent him/her.

As a result, American English developed the verb Mirandize, meaning "read the Miranda warning to" a suspect (when the suspect is arrested).



這是有關刑事的案件,任何說話可能成為呈堂證供,當然要謹慎處理,在未有律師陪同下,”必要的沉默“ 是需要的。


嗜悲 還也記得曾經有聽過:


"I do not agree with what you have to say, but I'll defend to the death your right to say it."


但是出自何人呢?


【維基百科】Evelyn Beatrice Hall (1868 – 1956), who wrote under the pseudonym S.G. Tallentyre, was an English writer best known for her biography of Voltaire entitled The Friends of Voltaire, which she completed in 1906.

In her biography on Voltaire, Hall wrote the phrase: "I disapprove of what you say, but I will defend to the death your right to say it" (which is often misattributed to Voltaire himself) as an illustration of Voltaire's beliefs. Hall's quotation is often cited to describe the principle of freedom of speech.



Freedom of Speech 要有聽眾,否則任人講都是的自己聽,那又有何作用呢?最常見所謂 ”言論自由“ 當然是在報章上發表,希望有讀者讀過讀到。


其他就首要是在 ”議會“ 內,極需要有 Freedom of Speech,讓代表選民的議員們,可以批評和監察政府的施政。


香港的立法會辯論 “財政預算” ,經過七十多小時還未獲得通過,因為大部份時間是 ”鳴鐘“,召喚離開會議廳的議員,在十五分鐘內返回會議廳,避免發生流會。





基本法第七十二條(一)給予 “立法會“ 主席權力,在是適當環境下終止辯論。上面的片段沒有包括一度十分有趣的 問與答,可惜一天之後就完全被 ”河蟹“ 掉了。


一問一答大致是這樣的:

陳志全 議員問:只給予 8小時發言,但同時未有法定人數的議員在會議廳內,每次點人數的 15分鐘,也需要計入 8小時之內?


曾鈺成 主席搭:咁!你不要時常要求點人數吧!


Maintaining 合法人數在 ”立法會“ 開會,因為不夠人數就有流會出現,其實已經出現過不少次,每次 曾鈺成 都力竭聲嘶,沉痛陳詞說得慷概激昂,對於發生流會心痛惡絕。但今次對於不夠人數,而會發生流會,曾主席就改口:”咁!你不要時常要求點人數吧!“ 把責任推了給人家。


曾鈺成 又在一天之後,梁振英 來到立法會大問答會。梁振英 一開始就以家長式口吻教訓人家,引致議員們抗議。其實以前每次例牌,曾鈺成 都會趕 黃毓民、梁國雄、陳偉業、和 陳志全 出會議廳。








最後,曾鈺成 腰斬了 ”梁振英到立法會答問大會“,不竟曾主席都只是個人,以個人水平而論他有沒有和能不能做到:


"I do not agree with what you have to say, but I'll defend to the death your right to say it."


根本這只是一個理想!


香港到了如今的環境,嗜悲 認為 ”必要的沉默“ 是需要的。

搞到乜都做唔到,
啲公共開支出唔到,
啲老人、貧困戶, 單親家庭等,
真正要人幫啲人,
全部無錢用,
無飯開架,

yes 以便兄 在如今的香港 “沉默” 是必需的,即是 DSE 所說:
